It’s important to stay updated on local laws and ensure your Medical and Hospitalization Leave policies are fair and clear. Here’s a straightforward guide to medical and hospitalization leave to help you navigate these aspects effectively.

What is Medical Leave?

Medical leave is paid time off that employees can use when they’re sick or dealing with health issues. Unlike regular annual leave, which is used for vacations or personal time, medical leave is specifically for health-related reasons.

What is Hospitalization Leave?

Hospitalization leave covers the time an employee needs to stay in the hospital or rest at home as advised by a doctor. This includes:

  • Time spent in the hospital, either as an inpatient or for outpatient surgery.
  • Cases where the employee needs bed rest at home, such as due to pregnancy complications.
  • Recovery time needed after being discharged from the hospital.

Malaysian Laws on Medical and Hospitalization Leave

Medical Leave

Under the Employment Act 1955 (EA), employees are entitled to paid sick leave based on their length of service:

  • Less than 2 years: 14 days of paid sick leave per year
  • More than 2 years but less than 5 years: 18 days of paid sick leave per year
  • More than 5 years: 22 days of paid sick leave per year

Employees must be examined by a registered medical practitioner to qualify for sick leave. If an employee takes sick leave without a medical certificate or fails to notify their employer within 48 hours, it’s considered an unapproved absence, which could lead to disciplinary action.

Hospitalization Leave

Employees covered by the EA are entitled to up to 60 days of paid sick leave per calendar year if they are hospitalized. This 60-day limit includes all types of sick leave, so both regular sick leave and hospitalization leave combined cannot exceed 60 days per year.

What About Employees Not Covered by EA?

For employees not covered by the EA, their sick leave benefits are determined by their employment contract or company policy.

Frequently Asked Questions About Medical and Hospitalization Leave

  • If an employee takes sick leave, does it affect their hospitalization leave?
Yes, it does. According to the Employment Act, the total amount of paid sick leave, including hospitalization leave, cannot exceed 60 days per year. So, if an employee uses sick leave, it will reduce the number of days they have available for hospitalization leave. Example: If an employee is entitled to 14 days of sick leave, they will have 46 days of hospitalization leave remaining for the year.

  • Are there medical benefits for employees under the Social Security Organisation (SOCSO)?
Yes, SOCSO provides free medical treatment for work-related injuries or occupational diseases at SOCSO’s panel clinics or government hospitals. For serious cases, employees can receive care at government hospitals, including specialist treatments. SOCSO also reimburses expenses for medical treatment at non-panel clinics, subject to their conditions.

  • Can an employer dismiss an employee for submitting fake medical certificates?
Yes, submitting fake medical certificates is considered misconduct under the Employment Act. Employers can dismiss an employee for this kind of misconduct without notice, or take other disciplinary actions as deemed appropriate.

  • When is an employee not entitled to paid sick leave?
Employees are not entitled to paid sick leave during maternity leave or when receiving compensation under Workmen's Compensation or SOCSO.

  • Do employees get a replacement leave if they fall sick on a public holiday?
Yes, if an employee is on sick leave or annual leave during a public holiday, they are entitled to a replacement day off with pay.

Managing leave is crucial for fostering a positive and healthy work environment. When done right, it supports a culture where employees feel valued and motivated to contribute their best.
