Responsibilities

Reports To: DIRECTOR

Job Purpose

The HR Executive will manage the full lifecycle of the workforce, with a heavy emphasis on the administration, welfare, and compliance of foreign workers. This role ensures that the company adheres to the Employment Act 1955, Act 446, and Immigration Department guidelines while maintaining operational efficiency through effective scheduling and payroll.

Key Responsibilities

1. Foreign Worker Management & Compliance

  • Documentation: Manage work permit (PLKS) renewals, passport renewals, and insurance (FWCS/SKHPPA) for all foreign employees.
  • Liaison: Act as the primary point of contact for the Immigration Department, JTK (Jabatan Tenaga Kerja), and relevant embassies.
  • Medical: Coordinate annual FOMEMA medical examinations and manage hospital/clinic visits for workers.
  • Recruitment: Assist in the end-to-end process of hiring foreign labor, including quota applications and arrival clearances (kliq/e-VDR).

2. Welfare & Accommodation (Act 446)

  • Hostel Management: Ensure worker accommodations comply with the Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990 (Act 446).
  • Health & Safety: Conduct regular hostel inspections to ensure hygiene, safety, and basic amenities are maintained.
  • Conflict Resolution: Handle grievances, counseling, and disputes among the foreign workforce.

3. Manpower Scheduling & Attendance

  • Rostering: Create and manage weekly/monthly work schedules, including shift rotations (e.g., 12-hour shifts, 4-on-2-off).
  • Overtime (OT) Control: Monitor and verify OT hours to ensure they stay within the legal limit (104 hours per month) and meet operational targets.
  • Attendance Tracking: Monitor daily clock-ins/outs and manage absenteeism or "Runaway" (Permit Absconding) reporting.

4. Payroll & Salary Administration

  • Calculations: Process monthly payroll, ensuring accurate calculation of Minimum Wage, Overtime (1.5x, 2.0x, 3.0x), and Public Holiday pay.
  • Ductions: Manage legal salary deductions (advances, hostel utilities where applicable) ensuring they do not exceed 50% of the total wages as per the Employment Act.
  • Statutory: Ensure SOCSO (now mandatory for foreign workers) and EIS contributions are processed correctly.

Job Requirements

  • Education: Diploma/Degree in HR, Business, or a related field.
  • Experience: Minimum 2 years of experience specifically handling Foreign Worker management in a manufacturing, construction, or service environment.
  • Regulatory Knowledge: * Strong grasp of the Employment Act 1955 (2022 Amendments).
  • Familiarity with Act 446 (Hostel compliance).
  • Knowledge of the Check-Out Memo (COM) process for repatriating workers.
  • Technical Skills: Proficiency in Excel (for shift planning) and Payroll software.
  • Languages: * Required: Bahasa Malaysia & English.
  • Added Advantage: Ability to speak Bengali, Nepali, Hindi, or Indonesian to communicate directly with workers.
  • Availability: Willingness to be "on-call" for emergencies related to worker welfare (e.g., medical emergencies after hours).

Key Performance Indicators (KPIs)

  • Zero Non-Compliance: No fines or compounds from JTK or Immigration.
  • Permit Renewal: 100% of work permits renewed at least 2 months before expiry.
  • Payroll Accuracy: Zero errors in monthly OT and salary disbursements.
  • Worker Retention: Low turnover/absconding rate among the foreign workforce.
