Position Summary

The Group Commercial & Transfer Pricing Executive is responsible for developing, implementing, and maintaining the Group's commercial pricing framework, transfer pricing policies, intercompany charging mechanisms, and financial optimization strategies. The role will ensure that all Group entities are appropriately compensated for services rendered, improve profitability across the Group, minimize tax risks, and support corporate restructuring, expansion initiatives, and future listing exercises.

The Executive will work closely with the CFO, Country Manager, Finance, Legal, Human Resources, Procurement, and Business Development teams to ensure that commercial and financial arrangements are properly documented, commercially justifiable, and compliant with applicable tax and regulatory requirements.

Key Responsibilities

1. Commercial Pricing & Profitability

  • Develop and maintain the Group's commercial pricing framework.
  • Review the profitability of each business unit, branch, and subsidiary.
  • Analyze project margins and recommend improvements to maximize profitability.
  • Develop pricing models for internal and external commercial services.
  • Conduct periodic commercial performance reviews and present recommendations to Management.

2. Transfer Pricing

  • Develop and maintain Transfer Pricing policies for all Group entities.
  • Prepare and maintain Transfer Pricing documentation in compliance with Malaysian Transfer Pricing Guidelines.
  • Establish appropriate intercompany pricing methodologies.
  • Maintain benchmarking studies supporting transfer pricing arrangements.
  • Review existing intercompany transactions and recommend improvements.
  • Coordinate with external tax consultants and auditors during transfer pricing reviews and audits.

3. Intercompany Charging

Develop and administer charging mechanisms for:

  • Management Services
  • Procurement Services
  • Human Resources
  • Payroll Administration
  • Legal Services
  • Tender Management
  • Business Development Support
  • Project Management Support
  • Administrative Services

Ensure all charges are commercially supportable, properly documented, and consistently applied across the Group.

4. Tax Planning & Optimization

  • Identify opportunities to improve tax efficiency across the Group.
  • Review Service Tax (SST) implications on intercompany transactions.
  • Support annual tax planning initiatives.
  • Assist in mitigating tax risks and exposures.
  • Work with external tax advisers on tax planning and compliance matters.
  • Monitor changes in tax legislation and recommend appropriate actions.

5. Financial & Commercial Analysis

  • Prepare profitability analysis by company, project, and business unit.
  • Analyze cost structures and recommend optimization initiatives.
  • Prepare commercial feasibility studies for new business ventures.
  • Develop financial models to support strategic decision-making.
  • Produce monthly commercial and financial performance reports for Management.

6. Corporate Structuring

Assist Management in reviewing and improving:

  • Group corporate structure
  • Profit centre allocation
  • Cost centre allocation
  • Investment structures
  • Regional operating models
  • Business expansion strategies

7. IPO & Corporate Exercise Support

  • Support preparations for potential IPO or corporate restructuring exercises.
  • Assist in enhancing the financial performance of the listing entity.
  • Prepare financial and commercial information required by investment bankers, auditors, and advisers.
  • Assist in implementing governance and financial reporting improvements.

8. Compliance & Governance

Ensure compliance with:

  • Malaysian Income Tax Act
  • Malaysian Transfer Pricing Guidelines
  • OECD Transfer Pricing Principles
  • Service Tax legislation
  • Corporate governance policies
  • Internal financial policies and procedures

9. Process Improvement

  • Develop and improve SOPs relating to commercial pricing and intercompany transactions.
  • Recommend automation and digitalization of commercial and financial processes.
  • Improve reporting accuracy and efficiency.
  • Assist in implementing ERP and financial system enhancements where applicable.

10. Stakeholder Management

Liaise and collaborate with:

  • Successful implementation and maintenance of the Group's Transfer Pricing Policy.
  • Improvement in Group profitability through optimised pricing strategies.
  • Reduction in tax risks and compliance issues.
  • Timely preparation of Transfer Pricing documentation.
  • Effective implementation of intercompany charging mechanisms.
  • Identification and implementation of tax-saving and commercial optimisation initiatives.
  • Timely preparation of commercial analysis and management reports.
  • Reduction in reliance on external consultants through the development of internal expertise.
  • Continuous improvement of commercial and financial processes.

Qualifications

  • Bachelor's Degree in Accounting, Finance, Taxation, Economics, Business Administration, or a related discipline.
  • Professional qualifications such as ACCA, CPA, CIMA, ICAEW, CTIM, or equivalent will be an added advantage.
  • Minimum 3–5 years of relevant experience in commercial finance, transfer pricing, taxation, financial analysis, or corporate finance.
  • Experience with multinational corporations, shared service environments, or public accounting firms is preferred.

  • Strong understanding of Transfer Pricing principles and Malaysian tax regulations.
